What Wichita’s Fence Rules Mean for Your Project

Wichita and Sedgwick County share one zoning code and one building code. Here is what they say about residential fences.

No Building Permit Up to 8 Feet

The combined Wichita–Sedgwick County building and trade code exempts fences not over 8 feet high from a building permit. A taller fence needs one.

8 Feet in Front, Side & Rear Yards

The Unified Zoning Code allows fences up to 8 feet in required setbacks, front yards included, measured on the side of the fence with the least exposure above finished grade.

3 Feet Near Corners & Driveways

A fence more than 80 percent solid, which includes any privacy fence, is limited to 3 feet within 20 feet of where a side lot line meets the street right-of-way and within 20 feet of a driveway intersection.

Open Ornamental Fences at Corners

The traffic ordinance makes an exception in the vision triangle for an ornamental fence under 4 feet that is at least four parts open to one part solid, so open styles such as wrought iron can qualify.

60-Inch Pool Barriers

Wichita city code 7.72.020 requires a 60-inch enclosure around pools 2 feet or more deep, hot tubs and spas included, with the gate latched whenever an adult isn’t present. A locked spa cover can stand in for a hot tub enclosure.

Drainage Covenants on Newer Lots

Many newer plats carry a covenant under the Backyard Drainage Policy: drainage easements stay at established grades and unobstructed, and owners give anyone installing a fence the Individual Lot Grading Plan and Certificate.

That doesn’t mean anything goes: near street corners and driveways a mostly solid fence is limited to 3 feet, and HOA covenants are often stricter than the city. The exception is near a street corner or a driveway: within 20 feet of those points, a privacy fence has to stay at 3 feet or less. An ornamental fence under 4 feet that is at least four parts open to one part solid can qualify there.
Wichita city code 7.72.020 requires a 60-inch enclosure people can’t get through around any pool 2 feet or more deep, hot tubs and spas included, and the gate must be latched whenever an adult isn’t present. Be careful. Many newer subdivisions carry a covenant under the Backyard Drainage Policy that keeps drainage easements at established grades and unobstructed, so a fence must not fill, dam, or divert a swale. Most 6-foot wood privacy fences in the Wichita area are set 30 to 36 inches deep in concrete. That puts the footing below the 24-inch local frost depth and gives the post the leverage it needs in Kansas wind.
