$25 Permit & City Inspection
Derby’s fence permit covers new and replacement fences. The $25 fee is non-refundable, the city asks for 48 hours to process it, and the finished fence is inspected, with inspections scheduled at least 24 hours ahead.
A Drawing Comes First
The application isn’t accepted without a drawing that shows property lines, easements, structures, and the proposed fence location. The applicant is responsible for locating the property irons.
6 Feet in Back & Side Yards
Open and closed fences can be up to 6 feet tall behind the house. Residential fences can’t be built of metal paneling, woven wire, or welded wire, unless decorative metal panels are framed by another permitted material.
Open 36-Inch Fences Out Front
Front-yard fences must be open designs such as split rail, decorative metal, or picket, with pickets no wider than 3.5 inches and at least 4 inches apart, no taller than 36 inches, and no points on top.
Finished Side Toward the Street
On a wood fence that faces or can be seen from a public street, posts and bracing go on the inside, or the fence is built shadowbox style so both sides are finished.
Easements & Floodplain
In a drainage easement, the City Engineer must approve the fence before a permit is issued. It can’t divert storm water, and fences in drainage or utility easements need removable panels. A lot in a FEMA flood hazard area may also need a floodplain development permit.
